The Election Procedures Committee threw out all 11 charges contained in Furtados challenge.
When the charges were heard by the EPC, the progressive candidate, Furtado, was incapable of representing himself. He had Dave Arian make his case for him.
The entire matter hinged on the fact a phone call was made to the International allegedly for the purpose of inspecting the voter elegibility list. The call was made 2 hours and 15 minutes before the deadline for making such requests expired.
The phone call was not made by Wesley Furtado, but by Joe Cabralles of Local 10 who was representing Furtado.
The secretary at the International who received this call was on vacation during the EPC hearing and the IEB meeting. When she heard what took place she sent out a memo stating Cabralles had in fact called the International and spoke to her but he DID NOT REQUEST TO SEE THE VOTING LIST!
Now Jack this is the ILWU. If were about nothing else were about rank and file control and democracy. When this union conducts an election and it is ignored there had better be a damn good reason for it. The IEB in a 12 to 8 decision hung thier hat on a minority report summitted by a member of the EPC. The minority report, and all the discussion in the IEB centered on this phone call made 2 hours and 15 minutes before the deadline was up. And it turns out Furtado lied (or he had Arian lie for him) because no request was actually made. Since this information was revealed their have been a number of petitioners asking for the matter to be re-investigated. All have been ignored.
The rank and file needs to take a close look at what is going on here. This is the second time the IEB has voted to re-run an election. The last time the EPC was unamnimous in thier decision to throw out the challenge. But thier are a number of people in this union who feel it is o. k. to throw out an election on a pretense when you do not obtain the result you want. And this, Jack, is extremely dangerous in an organization founded on the principle of rank and file control and democracy.
